Contracts

 

Oh, we thought we got to keep the negatives' or ‘I on sold the photographs to the advertising agency. I thought we owned the copyright.'

 

One of the most important functions of a ‘contract' is to provide clarity for the client. The client needs to know exactly what services and products the photographer is providing, the copyright and usage issues, the costs and when monies are to be paid. The ‘contract' also needs to spell out what happens when the client requests changes or there are delays caused by factors beyond the control of the photographer.

 

Another function of the contract is to provide security for the photographer so that he/she can expend funds. A signature on an order form is an example of this.

 

Contracts can take the following forms:

 

  • Formal agreement

 

  • Letter countersigned by client

 

  • Quotation proforma that is countersigned by the client
